CashEngine Terms of Service

These terms apply to merchants who install CashEngine: Upsell & Bundles ("CashEngine") from the Shopify App Store. CashEngine is provided by Ehud Erlich ("we"). By installing the app you agree to these terms and to our Privacy Policy.
1. The service
CashEngine lets a Shopify merchant show upsell, bundle and quantity offers, apply discounts through Shopify, capture leads and send WhatsApp messages through the merchant's own account. Features depend on the plan the merchant chooses.
2. Plans and billing
Plans and prices are shown on the app's App Store listing and inside the app. All charges are billed by Shopify on the merchant's Shopify invoice. Paid plans may include a free trial. The merchant can change or cancel a plan at any time from the app; uninstalling the app cancels the subscription. Fees already billed are not refunded except where Shopify's policies or the law require it. Third-party services the merchant connects, such as Whapi.Cloud, are billed by those providers.
3. Merchant responsibilities
The merchant is responsible for the offers, prices and messages it configures; for having a lawful basis and any required consent to contact its customers; for complying with consumer protection, marketing, anti-spam and privacy laws; and for complying with WhatsApp's and Whapi's terms when using the WhatsApp features.
4. Acceptable use
The merchant may not use CashEngine to send spam, to show false or misleading claims (such as fake scarcity or fake reviews), to add charges without the shopper's clear consent, or to break Shopify's terms.
5. Data
The merchant owns its store data and its customers' data. We process it only to provide the service, as described in the Privacy Policy, and act as the merchant's processor for shopper data.
6. Availability and changes
We work to keep the app available and correct but do not guarantee uninterrupted service. We may change features; we will tell merchants in the app before removing a paid feature they use.
7. Liability
The app is provided "as is". To the extent the law allows, our total liability for any claim is limited to the fees the merchant paid for the app in the three months before the claim, and we are not liable for indirect or consequential losses, including lost profits.
8. Termination
The merchant can stop using the app at any time by uninstalling it. We may suspend an account that breaks these terms. After uninstall, data is deleted as described in the Privacy Policy.
9. Law
These terms are governed by the laws of the State of Israel, and the courts of Tel Aviv have jurisdiction, unless mandatory law where the merchant is located says otherwise.
